DCC 94/2010

This case involved a claim for dues including severance pay and holiday pay by an employee who had been dismissed. The key arguments involved the statute of limitation for holiday pay and the status of evidence which it was alleged had been amended.

Background

An employee filed a case against a company and requested the court order the company to pay her 27000 AED and annual interest of 2%. The employee stated she had started work with the company on 12/09/2006 and was dismissed on 31/12/2009 but the company had refused to pay her dues.

The court ruled that the company should pay the employee 182000 AED and annual interest of 9% plus provide the value of a flight ticket.

The company and the employee appealed the ruling before the court of appeal. The court changed the ruling and ruled the company should pay the employee 155584 AED, the value of a flight ticket and annual interest of 9%.

The employee and the company appealed the ruling before the court of cassation (Appeal No. 94/2010) and (Appeal No. 95/2010).
