DCC 81/2010

This case involved amounts which were due by an employer and their employee to each other on the termination of the employee's employment. The court had wrongly ruled an amount which was different than the expert's report without giving reasons.

Background

An employee filed a case against a company and requested the court order the company to pay him 3.431.702 AED, annual interest and the value of a flight ticket. The employee stated he had started work with the company on 01/08/2001 and had resigned on 10/04/2008. The employee stated the company had refused to pay his dues.

The company requested the court to order the employee to pay 20.037.992 AED and annual interest.

The court ruled the company should pay the employee 356.707 AED and annual interest of 9%.

The court ruled that the employee should pay the company 705.354 AED and annual interest of 9%.

The employee and the company appealed the ruling before the court of appeal. The court ruled the employee should pay the company 53232 AED and upheld the appealed ruling on the other points.
