Unfair dismissal – Dues – Flight Ticket – Family – Appeals
This case involved a claim for dues, including a flight ticket for the employee and their family following an unfair dismissal. Only the flight ticket for the employee was awarded. The key issue in this case was there was an attempt to introduce an argument at the court of cassation which had not been introduced at the elementary court. This was not possible.
Background
An employee filed a case against a company and requested the court to order the company to pay him 1.335497 AED, annual interest and the value of a flight ticket for him and for his family. The employee stated he had started work with the company on 17/08/2003 and that he was unfairly dismissed on 01/03/2009. The employee stated the company had refused to pay his dues.
The court ruled that the company should pay the employee 211.479 AED, 5% annual interest and the value of a flight ticket.
The company and the employee appealed the ruling before the court of appeal. The court upheld the ruling.
