This case involved where a dismissal had been unfair and compensation was due. The employer argued they had fairly dismissed the employee as they had exploited their position for their personal interests. The court stated they had the authority to decide if the dismissal had been unfair.

Background

An employee filed a case against a company and requested the court order the company to pay him 567.539 AED and commission of $405.667 which was 1% of the company's capital according to an agreement between the two parties. The employee also requested the court order the company to pay annual interest of 9%. The employee stated he had started working with the company on 01/10/2004 and was dismissed on 27/09/2009 without justifications. The company had refused to pay his dues.

The company requested the court to order the employee to pay 338258 AED.

The court ruled the company should pay the employee 473.549 AED and annual interest of 9% but rejected other requests.

The court ruled that the employee should pay the company 220.35 AED.

The company and the employee appealed the ruling before the court of appeal. The court rejected the appeals and upheld the ruling.
