Litigation Procedure – Value of Case – Appeal – Unfair Dismissal
This case involved a claim for damages for unfair dismissal. The key issue in this case was that it should not have gone before the court of cassation as the amounts involved were too low.
Background
An employee filed a case against a company and requested the court order the company to pay him 193.708 AED and annual interest. The employee stated he had started working with the company on 15/10/1989 and that been unfairly dismissed.
The company requested the court to order the employee to pay 107.900 AED (the value of losses he caused, 4500 AED for cancelling the contract and 35000 AED of a loan he received.
The court ruled that the company should pay the employee 68.641 AED, annual interest of 9% and the value of a flight ticket.
The court ruled that the employee should pay the company 35000 AED and annual interest of 9% but rejected the other requests.
