Dismissal – Dues – Profit share – Employee – Transfer between two companies – Expert report – Court Authority - Evidence
This case involved an employee who had been dismissed and made claims against two companies as there had been an internal transfer. He claimed a share of the second company's profits which was rejected and he disputed the expert report. The court had authority to decide on all aspects of the case and it stated the expert report proved the second company had not earned any revenue until after the employee left.
Background
An employee filed a case against two companies and requested the court to order the companies to pay him 709753 Dirhams and 10% of the second company's profits plus the value of a flight ticket. The employee stated he had started working with the first company on 01/10/2006 and was then internally transferred to the second company. The employee stated that he was dismissed from his job on 14/09/2009.
The court ruled that the companies should pay the employee 415855 AED and the value of a flight ticket.
The company and the employee appealed the ruling before the court of appeal. The court rejected the two appeals and upheld the ruling.
