DCC 162/2010

The original dispute involved a claim by an employee for his dues following an unfair dismissal. The employee unsuccessfully argued the court had not explained the legal grounds on which the ruling was made. The court stated the employee had not provided sufficient documentation of the reasons for their appeal.

Background

An employee filed a case against a company and requested the court to order the company to pay him 217247 AED. The employee stated he had started working with the company on 08/10/2007 and was dismissed from his job on 06/01/2009 without justification. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee 97155 AED and the value of a flight ticket but rejected the other requests.

The employee and the company appealed the ruling before the court of appeal. The court rejected the two appeals and upheld the ruling.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal the ruling had insufficient evidence of causation because the ruling had not explained the legal grounds upon which it was established.
