Labour Cases – Statute of Limitations – Foreigner – Complaint with labour department
This case involved whether a labour case was covered by the statute of limitations. The employee had raised the complaint with the labour department and argued as a foreigner he did not know the local laws. This argument was rejected.
Background
An employee filed a case against two companies and requested the court to order them to jointly pay 229800 AED, annual interest of 12% and the value of a flight ticket. The employee stated he had started working with the companies on 01/04/2008 and was dismissed from his job on 14/12/2008. The employee stated the companies had refused to pay his dues.
The court rejected the case.
The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the companies should pay the employee 9600 AED.
