DCC 154/2010

This case involved a claim for dues by an employee who had been dismissed. There were point issues. The first was whether annual holiday was due as the employee had taken the holiday in the first year of his employment. The second was whether the court should have explained the expert's recommendation on the value of a loan which had been given to the employee.

Background

An employee filed a case against a company and requested the court order the company to pay him 860.774 AED and annual interest. The employee stated he had started working with the company on 19/04/2007 and was dismissed on 19/02/2009. The employee stated the company had refused to pay his dues.

The company requested the court to order the employee to pay 100000 AED of the value of a loan he had previously received.

The court ruled that the company should pay the employee 483479 AED, annual interest of 9% plus the value of a flight ticket. The court rejected the company's request.

The company appealed the ruling before the court of appeal. The court upheld the ruling.
