DCC 137/2010

The original dispute involved a claim for compensation by an employee who had been unfairly dismissed. The key issue was whether the expert had carried out his work properly. The court had authority to assess this and the employee had not provided a clear enough explanation of the expert's shortcomings.

Background

An employee filed a case against a company and requested the court to order the company to pay him 1.891.366 AED. The employee stated he had started work with the company on 17/11/2008 and was unfairly dismissed on 25/09/2009. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee 6133 AED and rejected the other requests.

The employee appealed the ruling before the court of appeal. The court upheld the ruling.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal the ruling had erred in the application of law and had insufficient evidence of causation because the expert appointed by the court had not executed his task properly.
