The original dispute involved a claim by an employee for unpaid dues following their unfair dismissal. The employer tried to argue at the court of cassation that the court should have ruled on a clearance settling the money the employee owed the company and the money the company owed the employee. This argument was rejected as it should have been presented to the elementary court.
Background
An employee filed a case against a company and requested the court to order the company to pay him 465.660 AED and the value of flight tickets. The employee stated he had started working with the company on 10/03/2008 and was dismissed from his job on 18/12/2008 without justification. The employee stated the company had refused to pay his dues.
The court ruled that the company should pay the employee 216.000 AED and the value of a flight ticket.
The employee and the company appealed the ruling before the court of appeal. The court changed the ruling and ruled that the company should pay the employee 243.000 AED.
