DCC 101/2010

This case involved an employee who had left his employment after his wages were not paid. His employer argued that the court should have followed its request to appoint an expert to review what was owed. The court rejected this as the court had the authority to decide on such matters based on the case documents.

Background

An employee filed a case against a company and requested the court order them to pay him 589.755 AED and the value of a flight ticket. The employee stated he had started his working with the company on 01/04/2007 and left his job on 13/09/2009 because the company had refused to pay his wages.

The court ruled that the company should pay the employee 162.217 Dirhams and the value of a flight ticket but rejected other requests.

The company and the employee appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 176.750 AED.

Decision

The company and the employee appealed the ruling before the court of cassation (Appeal No. 101/2010) and (Appeal No. 109/2010).
