Unfair Dismissal – Compensation – Indefinite Employment Contract – Court Authority
This case involved a claim for compensation for unfair dismissal. The employee tried to argue the court's compensation award was lower than required by law. This was not the case as there had been an indefinite employment contract and the court had the authority to decide on the compensation level.
Background
An employee filed a case against a company and requested the court to order the company to pay him 497.832 AED and annual interest. The employee stated he had started work with the company on 10/03/2008 and was unfairly dismissed on 13/11/2008. The employee stated the company had refused to pay his dues.
The court ruled that the company should pay the employee the value of a flight ticket and rejected the other requests.
The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the company should pay the employee 60000 AED.
