Employment Contract – Housing – Termination of Employment – Eviction – Dues – Rent
This case involved an employee who had been dismissed but his dues had not been paid. The key question was whether he should still be entitled to stay in his house and if the company should pay the rent. It was a violation of the employment contract for the employer to not continue to pay the rent until the dues had been paid.
Background
An employee filed a case against a company and requested the court order the company to pay him 453000 AED. The employee stated he had started working with the company on 19/09/2007 and was dismissed on 27/04/2009. The employee stated the company had refused to pay his dues.
The company requested the court to order the employee to pay 571361 AED and annual interest.
The court ruled that the company should pay the employee 244666 AED and the value of a flight ticket for him and his family.
The court rejected the company's request.
The company and the employee appealed the ruling before the court of appeal. The court upheld the ruling.
