DCC 79/2010

This case involved a claim by an employee who had not been paid his salary. An appeal could not be made to the court of cassation as the amount involved was too small.

Background

An employee filed a case against a company and requested the court to order the company to pay him 88.700 AED and annual interest of 9%. The employee stated he had worked with the company from 15/10/2007 to 02/08/2008 and the company had refused to pay his salary.

The court ruled that the company should pay the employee the value of a flight ticket and rejected the other requests.

The employee appealed the ruling before the court of appeal. The court ruled the company should pay the employee 71000 AED and annual interest of 9% plus the value of a flight ticket.

The company appealed the ruling before the court of cassation.

The court said that Article 173 of the Civil Procedures Law stipulated that the labour cases with a value less than 200000 Dirhams cannot be appealed before the court of cassation.

The court dismissed the appeal.
