Conveyancing – Contract – Sale of Property – Capacity
This case involved whether it was possible for a sale to be agreed by one party but the contract to be concluded with another due to a change of ownership of the property before the sale.
Background
Some Plaintiffs filed suit No. 18 of 2009 against the Defendant (Real estate company) requesting the termination of a contractual relationship with the Defendant and payment of 3882652 AED plus 12% commercial interest starting from 9-3-2008. The lawsuit was filed based on the fact that the Plaintiffs, based on some oral negotiations, agreed with the Respondents to buy from an apartment in Ajman with a ground area of 1,522,609 feet and a price of 255 AED per foot.
The Plaintiffs paid the floor's price and agreed with the Defendant to send the contract to sign it.
