Termination of Employment – Compensation – Unpaid Dues – Financial Crimes – Notification of Investigation
This case involved a claim for unpaid dues and compensation by an employee who had been dismissed. The employer claimed they had not been unfairly dismissed because the employee had committed financial crimes and they were justified in dismissing them in such cases. The employee stated they had not been informed of the accusations against them for two months. However, they could not get compensation as they had not proved the dismissal was unfair.
Background
An employee filed a case against a company and requested the court order the company to pay him 2.113.750 AED and annual interest of 9%. The employee stated he had started working with the company on 21/10/2007 and had been dismissed from his job on 07/07/2008. The employee stated the company had refused to pay his dues.
The company requested the court to order the employee to pay 9756240 AED and annual interest of 9%.
The court ruled that the company should pay the employee 1.400000 AED and annual interest of 9% and rejected other requests. The court rejected the company's request.
