Unfair Dismissal – Unpaid Dues – Period for Calculating Dues – Court Authority – Evidence
This case involved a claim for unpaid dues after an unfair dismissal. The employer produced evidence which showed the employee had been absent over a specific period and argued these dates should not be used in the calculation. The court had authority to decide when an employment period should start and end for these purposes and ignored this.
Background
An employee filed a case against a company and requested the court to order the company to pay him 600425 AED and the value of flight ticket, and give up his passport. The employee stated he had started working with the company on 01/03/2007 and had been dismissed from his job on 14/01/2009 without justification. The employee stated the company had refused to pay his dues.
The court ruled that the company should pay the employee 398.760 AED and the value of a flight ticket. It should also give up the passport.
The employee and the company appealed the ruling before the court of appeal. The court changed the ruling and ruled that the company should pay the employee 418.760 AED.
