Background Facts:
The Appellants claimed that under a contract signed on 09/11/2006 the Respondent sold them units on the Mezzanine Floor in a project taking place on the land in Dubai for 459.420 AED. The appellants paid 188244 AED and they agreed that they would pay the full amount by the end of 2008.
On 25/11/2007 the Respondent told them that the second instalment should be postponed until they start digging excepted on 25/12/2007. However, the drilling did not take place and the Appellants sent a notification to the Respondent reminding them that the contract had to be executed and had to be registered according to Dubai Law No. 13/2008. They also reminded them that it is necessary to conform with the rules in Dubai Law No. 8/2007* on escrow counts. However, the company did not comply with the demands.
The department of land and property issued a statement saying that the sales contract was not registered.
