Termination of Employment – Resignation – Notice – Flight Tickets – Holiday Pay – Severance Pay
This case involved an employee who claimed he had been dismissed from his job but it was proved had left without giving notice. As a result he could not claim holiday pay, severance pay or the cost of flight tickets to his own country from the employer.
Background
An employee filed a case against a company and requested the court to order the company to pay him 572.834 Dirhams, annual interest and the value of a flight ticket. The employee stated he had started working with the company on 05/08/2004 and was dismissed on 18/02/2007. The employee stated the company refused to pay his dues.
The court rejected the case because the employee had failed to prove a working relationship with the company.
The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the employee 236.230 AED and annual interest of 9% plus the value of a flight ticket.
