This case involved a claim for unfair dismissal. Two key issues were considered whether the employee was to be treated as being under probation which impacted unfair dismissal and if the court was right to ignore a document as evidence which was not written in Arabic.

Background

An employee filed a case against a company and requested the court to order the company to pay him 371.200 AED and annual interest. The employee stated he started working with the company on 01/11/2008 and was unfairly dismissed from his job on 01/03/2009.

The court ruled the company should pay the employee 227200 AED.

The employee appealed the ruling before the court of appeal. The court changed the ruling and ruled the company should pay the employee 83200 AED.

Decision

The employee and the company appealed the ruling before the court of cassation (Appeal No. 25/2010) and (Appeal No. 31/2010).
