This case involved the sale of a property which did not go through when a proxy expired. Key issues included evidence which could be used to prove offer and acceptance when the litigant did not have a written contract.
Background
An Appellant filed suit No 20/2008 against a real estate company, a commercial company and another party demanding that the First and Second Defendant stop dealing with the apartments in a property until a case was final and to establish the validity and the enforceability of the sale agreement signed between them as an agent for the Third Respondent and himself as a purchaser, and to order the First and Second Defendants to transfer the ownership of the property.
The Plaintiff explained that on 29/11/2006, he agreed with the Third Respondent to buy the units mentioned above, and signed a seizure form worth 4,465,000 AED.
