DCC 1/2010

This case involved a claim for various dues including severance pay by an employee who stated he had been unfairly dismissed. This was turned down after it was established the employee had left of his own volition even though he stated his reason for leaving had been the employer's violations of the employment contract.

Background

An employee filed a case against a company and requested the court to order the company to pay him 605.182 AED, annual interest and the value of flight tickets. The employee also requested the court to appoint an expert to estimate commission. The employee stated they had started working with the company on 31/08/2002 and had been dismissed from their job on 08/04/2008 without justification. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee 419.206 AED and annual interest of 9% plus the value of a flight ticket.

The employee and the company appealed the ruling before the court of appeal. The court changed the ruling and ruled that the company should pay the employee 132.697 AED.
