This case involved a claim by a worker for compensation for unfair dismissal. The employer argued they had merely been following the article in the labour law which allowed employers to fairly dismiss workers who have carried out a crime or a strike. The court stated however, it had the authority to decide on the matter.
Background
An employee filed a case against a company and requested the court to order the company to pay him 705000 AED and annual interest at 9%. The employee stated he had started working with the company on 06/11/2006 and was unfairly dismissed on 28/01/2009.
The court ruled the company should pay the employee 213.242.10 AED and the value of a flight ticket.
The company and the employee appealed the ruling before the court of appeal. The court changed the ruling and ruled that the company should pay the employee 415242 AED.
