Background

An employee filed a case against a company and requested the court order the company to pay him 308875 AED and the annual interest. The employee said that he reached a clearance agreement with the company to receive 308875 Dirhams and his salaries until 31/072007. The employee said that the company paid 308875 Dirhams but refused to pay the salary.

The court ruled that the company should pay the employee 308875 Dirhams and rejected other requests.

The company appealed the ruling before the court of appeal. The court upheld the ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal the ruling had erred in the application of law and had insufficient evidence of causation because the court had ruled that the company should pay the employee 308875 AED although the company had already paid this amount according to a clearance agreement.
