DCC 104/2009

This case involved a claim by an employee for his dues following an unfair dismissal. It was argued by the employer that severance pay, pay in lieu of notice and compensation was not due as the employee had been employed for less than a year. The court stated this was not the case as the dismissal was unfair and the employee had actually been employed for over a year.

Background

An employee filed a case against a company and requested the court order the company to pay him 325948 AED and annual interest plus the value of a flight ticket. The employee stated he had started working with the company on 03/02/2008 and was unfairly dismissed on 22/02/2009. The employee stated the company had refused to pay his dues.

The court ruled the company should pay the employee 83334 AED and the value of a flight ticket but rejected other requests.

The employee and the company appealed the ruling before the court of appeal. The court changed the ruling and ruled that the company should pay the employee 174191 AED.
