DCC 83/2008, 86/2008

This case involved a claim by an employee who had been dismissed for his dues including commission. A key point was that when the Court of Cassation had referred the case back to the court of appeal that court should have followed the Court of Cassation's ruling.

Background

An employee filed a case against an employer (a lawyer) and requested the court order the employer to pay him 453741 AED and annual interest. The employee stated he had started working with the company on 01/09/1999 and was dismissed on 08/02/2004. The employee stated that the company had refused to pay his dues.

The company requested the court to appoint an expert to estimate the amount that the employee should pay them.

The court ruled the company should pay the employee 63531 AED, annual interest of 5% and the value of a flight ticket.

The court rejected the company's request.

The employee and the company appealed the ruling before the court of appeal. The court rejected the company's appeal and ruled the company should pay the employee 244.031 AED and annual interest of 9%.
