Unpaid Dues – Litigation Procedure – Ruling Notification – Non-Arabic speaking parties – Judgment
The original dispute involved a request by an employee for unpaid dues. The key issue in this case was the way the employer had been notified of the judgment. They claimed the court had not made enough effort to find their address and notification had been via the Arabic newspapers although neither party spoke Arabic. The court confirmed the notification process had followed the law.
Background
An employee filed a case against a company and requested the court order the company to pay him 1.182.372 AED and annual interest. The employee stated he had started working with the company on 11/12/2004 and the company had refused to pay his dues.
The court ruled the company should pay the employee 1.002.271 AED, the value of a flight ticket and 9% annual interest
The company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 646371 AED but upheld the ruling on the other points.
