DCC 72/2009

This case involved a request for maintenance by a woman who had been abandoned by her husband. The court considered the evidence from the witnesses. A key point was whether the maintenance and housing allowances were proportionate to the husband's income.

Background

As the wife of the Defendant, an Appellant gave birth to two sons and within the age of custody.

The Defendant had abandoned her, they had been in a separate room for a year and a half, and he was always assaulting her, drinking wine, and came home drunk. He also stopped spending money on her and her children.

In addition, she was notified that he had stopped paying rent for the villa which would lead to her eviction.

He was a businessman and owned a private villa for rent of least 450,000 AED per year and had private companies but also did not pay wages for the maid.
