Employment Contract – Dismissal – Dues – Rent – Housing – Evidence – Rights and Duties of Employers and Employees
This case involved a claim by an employee for his dues after he was dismissed. A key argument was whether his rent should be included as case documents showed the employer had taken responsibility for this. That was not the case as this responsibility was not recorded in the employment contract.
Background
An employee filed a case against a restaurant and requested the court order the company to pay him 550100 AED and the value of a flight ticket. The employee stated he had started working with the restaurant on 24/10/1992 and was dismissed from his job on 23/03/2008. The employee stated the restaurant had refused to pay his dues.
The court ruled the restaurant should pay the employee 39619 AED and the value of a flight ticket.
The employee and the restaurant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
