The initial dispute involved the non-payment of the agreed part of a deposit to a property seller by the agent following the purchaser's default. A key issue was whether the court had jurisdiction to consider the dispute.

Background

On 23-5-2007 a Defendant company entered into an agreement as an agent with the Plaintiff as a seller and the buyer.

The Plaintiff sold the apartment located in Burj Dubai for 5,263,321 AED plus 12,430 AED as commission for the Defendant company and registration fees and transfer of ownership of the sale.

The parties to the contract agreed that the buyer would pay  540000 AED as a down payment to the Plaintiff which would be  secured by the value of the apartment provided the buyer paid the rest of the price of the apartment on 24.6.2007.
