DCC 12/2009

The original dispute involved a claim for unpaid salary and interest by an employee who had resigned because their wages had not been paid. The key issue in this case was that an appeal could not be made as it had not been filed within the time limit.

Background

An employee filed a case against a company and requested the court order the company to pay him 790.772.75 AED and annual interest of 9%. The employee stated he had started work with the company on 01/03/2005 and had resigned because the company had not paid his salary since November 2006.

The company requested the court order the employee to pay 761.682 AED and annual interest.

The court rejected the case and the company's request.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the employee 531.173 AED and annual interest of 9% plus the value of a flight ticket.

The company appealed the ruling before the court of cassation.

The court dismissed the appeal in form because it had not been introduced within the legal deadline.
