DCC 101/2008

This case involved a claim for unpaid dues by an employee who had resigned. The company tried to argue a counter claim that the employee had taken out an unpaid loan had been wrongly ignored. Even though there was written evidence that the employee admitted the debt, the defence could not be used as it had not been presented till the court of cassation.

Background

An employee filed a case against a company and requested the court to order the company to pay him 282288 AED and annual interest. The employee stated he had started work with the company on 08/11/2003 and had resigned on 30/04/2007. The employee stated the company had refused to pay his dues.

The court ruled the company should pay the employee 187489 AED and 9% annual interest plus the value of a flight ticket.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
