Background
A Plaintiff brought forward proceedings (375/2007) before the Dubai Court of Appeal seeking the revocation of her termination from the Health and Medical Service Directorate.
The Plaintiff, a non-UAE citizen, had previously worked as pharmacist with the directorate, the Defendant, for 17 years and had been entrusted with highly classified drugs.
During her last months of service, unknowingly, she had lost 40 pills which were a controlled drug: and reported this.
Due to the gravity of the drugs which were lost, the Directorate, under instruction from the director, proceeded to form an investigative committee to determine the facts of the matter and concluded that the drugs had been lost due to her negligence.
The Committee recommended that the Plaintiff be dismissed and the Director of the Directorate proceeded to terminate the Plaintiff's service and impose a penalty of 25% on the end of service gratuity.
