Background

A company filed a case against an employee and requested the court order the employee to pay 5000000 AED and annual interest. The company stated the employee had started working for them on 01/04/2004 and had resigned on 08/05/2005 but had gone to work for a competitor violating their employment contract.

The court rejected the case.

The company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case because the company had not followed the correct legal procedures when filing the case.

The company appealed the ruling before the court of cassation. The court repealed the ruling and referred the case to the court of appeal. The court of appeal rejected the appeal and upheld the appealed ruling.
