DCC 74/2008
This case involved which part of a debt was a company debt and which part of it was a personal debt owed by the director. Key issues included what part of the debt had been incurred before the company's registration and the court's lack of consideration of the details of an acknowlegment made by the director.
Background
A first Respondent (Plaintiff in the first instance) provided a service on behalf of the first Appellant and under their orders made payments and did work on their behalf .T hey acknowledged on 7/1/2006 their commitment to pay the amount claimed no later than 28-1-2006 or no more than 90 days from the date of approval before 6-4-2006. However, they did not , claiming that they had signed the debt bond in their capacity as the manager of the second Appellant company.
Following the failure to get the required money the Plaintiff filed the lawsuit and requested that the Defendants jointly pay 345,000 AED and interest of 9% from the date of the claim until full payment
