Employee – Dismissal – Two Companies – Severance Pay – Calculation – Basic Salary
This case was taken by an employee who had been dismissed against two companies and the first was ordered to pay an amount which included severance pay. The key issue was the way this severance pay had been calculated. The calculation should have been based on basic salary.
Background
An employee filed a case against two companies and requested the court order them to pay him 159.500 AED and the value of a flight ticket. The employee stated he had started working with the two companies in 1997 and was dismissed from his job on November 2006.
The court ruled that the first company should pay the employee 54500 AED and rejected other requests.
The employee appealed the ruling before the court of appeal. The court changed the ruling and ruled that the first company should pay the employee 54500 AED and the value of a flight ticket.
