Background Facts

A Respondent filed suit No. 87 of 2006 against the Appellant and an Insurance Company before the Dubai Court of First Instance requesting they pay two million AED as on 16-2-2004, while playing the octopus game belonging to the First Defendant and under its supervision, the Plaintiff fell from his seat and hit the ground which caused him injuries stated in the medical report. The Plaintiff claims that the institution had neglected a technical report issued by the Department of Environmental Protection and Safety of the Municipality of Dubai. Since the Second Defendant - the insurance company, was the insurer of the machines and equipment belonging to the institution, the Plaintiff was entitled to claim compensation for physical and moral damages suffered from them.
