Background

The Respondent (Plaintiff in the first instance) was an investor who owned 3,757,127 shares in a bank and 115,271 shares in an investment company.

The Appellant without having any right decided to seize or freeze these shares on the basis of a letter from the administrator of the estate, which caused the Plaintiff material and moral damages that required compensation, which prompted him to file this lawsuit.
