Background Facts
A Respondent bank filed suit No. 319 of 2007 before the Dubai Court of First Instance against the Appellant, requesting the Court to oblige him not to use the trade name owned by them and to strike it off from the Commercial Register and publish the ruling in two newspapers, one in Arabic and the other in English at the expense of the Defendant and to oblige the Department of Economic Development and Dubai Chamber of Commerce and Industry to take the necessary action in this regard.
The Plaintiff explained that it was a well-known international commercial bank and had a licensed branch in Dubai. It was the owner of the world-famous brand registered in many countries including the UAE. However, it had been proved the Defendant used their trademark which caused some confusion among the public and harmed its global name.
