DCC 27/2008

The original dispute involved an employee who been dismissed and not paid his dues. The employee tried to add another party to the proceedings but this was rejected. They then tried to argue the company was a ‘simulated company'. This case showed the evidence the courts used to determine the company was a real one.

Background

An employee filed a case against a company and requested the court to order the company to pay him 16.713.455 AED and 3% of sales made plus annual interest of 2%. The employee stated he had started working with the company on 02/08/2008 and was dismissed on 18/04/2006. The employee requested the court to add another company to the case and order it to pay the requested amount along with the first company.

The court refused to add the second defendant to the case and ruled the first company should pay the employee 16000 AED and annual interest of 9% but rejected the other requests.

The employee appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 32000 AED and the value of a flight ticket.
