Background
An Appellant filed suit No 277 of 2007 against the Respondents requesting to jointly oblige them to return diamonds which had been detained because of a detention No 188 of 2006 dated 30/03/2006 and was 702 Grams.
The diamonds had been seized from him on his return to Dubai from Kinshasa and the customs officer after the custom's officer inspected his belongings and found the diamonds. The Appellant stated in his claim that he was not subject to customs duties , in accordance with Article 22, 23 of Dubai Law No. 13/2004 on the control of import and exports of diamonds. It was stated the order to seize them had violated the Constitution and the Laws and he was entitled to have the goods returned. The Defendants pleaded that the case should be rejected as a result of the statute of limitations.
