This case involved a request for a provisional seizure on real property while a case to require the completion of a property sale was decided. In order to make such a request it was necessary that the requester actually owned the property as the property was not yet registered in their name they did not.

Background

An Appellant filed a demand on petition No 132/2007 against the Respondent ordering the signature of a provisional seizure of the real estate registered at the Land and Property department under the No 32 Tilal Emirate until the action on the origin of the right was examined.

On 30/08/2007, the judge issued an order signing the provisional seizure to a limit of 20,000,000 AED. The Respondent appealed the order through appeal No 123/2007 demanding that it be cancelled.

On 09/10/2007, the court accepted the appeal in form and in content and decided to amend the order and make it have a limit of 8,000,000 AED.
