This case involved whether heirs were liable to pay debts owed to a bank where their testator had agreed bank facilities which they had not paid and then had set up two limited liability companies.

Background

A bank filed suit No. 216/2002 against: an individual in his capacity as an heir and other heirs and two companies before the Dubai Court of First Instance requesting the first two Defendants, as heirs, and the second and third Defendant companies pay 34,655,000 AED and 12% interest per annum from the date of the claim until full payment.
