Background

A Respondent filed suit No. 797 of 2007 against the Appellant, the Attorney General in his capacity as representative of the Government of Dubai requesting the cancellation of the Resolution No. 128 of 2006 issued on 16-5-2006, dismissing the Plaintiff who was the head of the lighting department, from the date of his suspension from work on 9/4/2006, because he had shown an interest for himself and in not complying with the implementation of the provisions of the laws and regulations issued in respect of the duties of an employee, and was carrying out acts contrary to his duties. The Plaintiff requested the nullity of this decision and his reinstatement with the payment of full salary and financial dues from 9-4-2006 until he was reinstated.
