DCC 105, 132/2008

The initial dispute involved claims against a company because of the actions of its subordinates and an insurance company for damages. The key issue was how the claim amount was calculated for the purposes of allowing an appeal when there were multiple plaintiffs claiming different amounts against different defendants.

Backgroun d

The Plaintiffs filed suit No. 686/2006 against a company and national insurance company before the Dubai Court of First Instance, requesting the Court oblige the First Defendant to pay the Plaintiff 150,000 AED and the Second Defendant 100,000 AED and 9% interest from the date of the final judgment until full payment on the basis that on 9/1/2005, the subordinates of the First Defendant Company caused injury to the Plaintiffs. The subordinates of the First Defendant Company were convicted in misdemeanour No. 19981 of 2005. Since that company was responsible for the actions of its subordinates and the Second Defendant was the insurer of the Plaintiffs, then they should be held liable to pay compensation for the damage suffered by the Plaintiffs.
