This case involved liability for damage to a plants being shipped which had been inappropriately stored. Issued included who was classed the consignee and what happened if a court overlooked an issue.

Background

A Company filed suit No. 283 of 2005 against a party and the owners of the ship requesting they pay a $ 100,479 or its equivalent of 369,762 AED and 9% interest from the date of filing the claim until full payment. The Plaintiff explained that he agreed with the First Defendant to ship a quantity of live plants in two containers on board a ship from South Africa to Dubai. The First Defendant shipped the goods on the vessel . coming from South Africa to Jebel Ali under the Bill of Lading No.191001265 dated 24-4-2004. The shipment arrived at Jebel Ali port on 2-6-2004 in a damaged condition and after 36 days which was considered a long time for the trip.
