This case involved a claim against a company which owned a motor bike after an individual had pushed someone off the bike. It was within the court's authority to decide if there was sufficient evidence that the person was an employee of the vehicle owner. The case also discussed if someone who had sustained no permanent disability and had been treated in a state hospital free of charge should be eligible for compensation.

Background

A Plaintiff (First Respondent) filed proceedings before the Dubai Court of First Instance under roll (73/2006) seeking compensation for a tort damage inflicted on it against the First Defendant (the Second Respondent) and the Second Defendant (the Appellant) seeking a joint ruling against both.

The Claimant alleged that they had rented out a motorcycle from the Second Defendant and claimed that the First Defendant, an employee of the Second Defendant, had pushed over the motorcycle while she was riding the same: as a result, she was inflicted with a grave injury and sought compensation for both material (bodily damage) as well as moral damage that had been inflicted on her by the accident.
