DCC 35/2007

This case involved a claim by an employee who had resigned for his dues. It was argued he was not due anything as he had resigned but he had been forced to do so after being demoted. The company had no right to change the employee's position as stated in his contract of employment during the period of that contract.

Background

An employee filed a case against a company and requested the court to order the company to pay him 710511 AED, annual interest and the value of flight tickets for him and his family. The employee stated he had started working with the company on 01/06/1991 and had resigned on 01/06/2006. The employee stated the company had refused to pay his dues.

The company requested the court to order him to pay 107.500 AED and annual interest.

The court rejected the employee's case.

The court ruled the employee should pay the company 33.000 AED and annual interest of 9% but rejected other requests.

The employee and the company appealed the ruling before the court of appeal. The court rejected the two appeals and upheld the ruling.
