Background
A Plaintiff filed proceedings against two Defendants, who it alleged had promised to sell to him a number of apartments. The Plaintiff wanted to invalidate the sales agreement as it had not been complied with and had actually been misrepresented to him. The Defendants had sold the Plaintiff a right of benefit (lease) in the apartment for a long period of time, but as agreed full title and ownership to the Plaintiff.
The Plaintiff alleged that the Defendants had previously marketed to him the property and had promised the sale of the said property but he discovered that the contracts that were presented to him, after payment, were not actually contracts of sale but long-term lease agreements. The Defendants alleged that they had, from the outset, presented their marketing campaign as a long-term lease of property campaign, rather than a sales campaign.
